The Court of Appeal has ruled that the starting point for sentencing must be that the applicable maximum sentence is 15 years and 8 months, because, pursuant to art. 63 of the Penal Code, a period of 4 months must be deducted from the maximum sentence of 16 years, which in principle applies. This judgment is not correct, as it appears from the contents of the excerpt of the judicial documentation that after the proven crimes the accused was also sentenced to 5 years imprisonment.
