What is Prison Law?
Prison law regulates the execution of sentences and measures. If you are detained in a prison or remand center, you will be subject to the rules of prison law. Colloquially, this is also called detention law. Whether it concerns the rejection of a leave request, incorrectly delivered groceries, placement in an isolation cell, or problems surrounding detention phasing: for someone confined within four prison walls or staying in a clinic, these kinds of issues are everyday occurrences and therefore of great importance. If you feel that you are not being treated correctly or that prison rules are not being followed, we can help you take legal action.
Where is Prison Law Regulated?
Prison law is divided across various laws and regulations. As a result, it is not always easy to figure out what your rights are and which legal procedures are available in your case. Our lawyers can inform and advise you on this. The main sources of prison law are:
- The Penitentiary Principles Act (PPA)
- The Penitentiary Measure (PM)
- Regulation on Selection, Placement and Transfer of Detainees (RSPTD)
- Regulation on Temporary Leave from the Institution (RTLI)
- Principles Act for the Care of Persons Detained by Court Order (PACPDCO)
- Principles Act for Juvenile Justice Institutions (PAJJI)
What are Common Issues that Detainees Face?
Within prison walls, it’s important to know your rights. Even more important is knowing what legal steps you can take if you believe your rights are being violated. We have therefore compiled a list of common issues within the prison system for you.
