Residential closure under section 13b Opium Act suspended

On December 17, 2015, the interim relief judge of the Limburg District Court ruled on the request for an interim relief filed by Ms. J.J.H.M. de Crom in the context of a residential closure. Following the discovery of a hemp plantation in the garage, the mayor of the Municipality of Landgraaf wanted to close the entire property including the house for a period of three months under Section 13b of the Opium Act. This would soon put the residents on the street, with all its consequences.

It was argued on behalf of the applicants that the mayor's decision could not be upheld at the objection stage and that a preliminary injunction should be granted because of urgency. According to de Crom, such special circumstances exist in this case, which should lead to a partial closure of only the garage.

The interim relief judge of the District Court of Limburg is of the opinion that the interests of the residents in this case must outweigh the interests of the Municipality of Landgraaf. Thus, pending the ongoing objection phase, the Municipality may not close the plot including the house.
