Client is suspected of attempted manslaughter of an arresting officer. Earlier, the court had ruled that client no longer needed to be detained for that offense. When other judges later sought to reverse that decision, we appealed on behalf of client. The court ruled that there had been repeated application of pretrial detention for an offense for which the serious objections had previously been dropped, while there were no new facts or circumstances underlying that repeated application. The court honored the defense that this was a violation of the principle Nemo debet bis vexari. Thus, the appeal was granted and client was immediately released.
