The defendant, together with her (former) husband, committed fraud and theft of her, now deceased, then 77-year-old mother. In doing so, the defendant and the co-accused used up almost the entire assets of the victim in a relatively short period (of four months). The court assumes that the amount approached exceeded €100,000.

The court, also in view of the confessed statement made by the defendant at the appeal hearing, the defendant's personal circumstances and the violation of the reasonable period of time, imposes a sentence of imprisonment for the duration of 4 months, fully suspended, with a probation period of 2 years and community service for the duration of 240 hours.
